Centre for Public Policy Research (CPPR) in association with Study Group on International Law and Relations, Kerala, hosted a live webinar on the topic “‘Enrica Lexie Award: The Takeaways for India” at 5:00 pm on July 16 (Thursday), 2020. The webinar discussed the two main concerns with the Enrica Lexie incident, namely; whether India had jurisdiction and, if the Italian marines had immunity.
The distinguished panellists included Advocate VM Syam Kumar, High Court of Kerala, Kochi, Deepak Raju, Senior Associate at Sidley Austin LLP, Geneva. The discussion was moderated by Nithin Ramakrishnan, (Researcher Scholar, CPPR & Assistant Professor, CVV), Dr Harisankar K Sathyapalan (Research Fellow, CPPR & Assistant Professor, CUSAT) gave the introductory remarks and Dr Shannu Narayan (Assistant Professor, IIM Calicut) gave the concluding remarks. The Enrica Lexie case, which took almost 8 years to settle at the international level was discussed in detail with the speakers highlighting the fundamental issues involved in the case; 1) Jurisdiction and, 2) The diplomatic immunity for the marines/soldiers in private ships.The captains of such private ships do not have any authority over the armed marines appointed.
